{"id":5230,"date":"2019-07-16T17:45:10","date_gmt":"2019-07-16T22:45:10","guid":{"rendered":"https:\/\/www.appliedpolicy.com\/staging\/7403\/?p=5230"},"modified":"2021-06-21T16:10:30","modified_gmt":"2021-06-21T21:10:30","slug":"cms-estimates-over-600-million-in-savings-from-changes-to-long-term-care-facility-requirements","status":"publish","type":"post","link":"https:\/\/www.appliedpolicy.com\/staging\/7403\/cms-estimates-over-600-million-in-savings-from-changes-to-long-term-care-facility-requirements\/","title":{"rendered":"CMS Estimates Over $600 Million in Savings from Changes to Long Term Care Facility Requirements"},"content":{"rendered":"<p>[vc_row full_width=&#8221;stretch_row&#8221; gap=&#8221;35&#8243;][vc_column][vc_column_text]On July 16, 2019, Centers for Medicare and Medicaid Services (CMS) released proposed changes to requirements for Long Term Care facilities.<\/p>\n<p><strong>Comments are due September 16, 2019.<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>CMS proposes changes to <a href=\"https:\/\/www.federalregister.gov\/documents\/2019\/07\/18\/2019-14946\/medicare-and-medicaid-programs-requirements-for-long-term-care-facilities-regulatory-provisions-to\">Long Term Care (LTC) facility requirements<\/a> and estimates administrative cost savings of $616 million annually over five years. As part of the Administration&#8217;s <em>Patients Over Paperwork<\/em> initiative, these savings will come from reductions and reforms in requirements for:<\/p>\n<ul>\n<li>Information collection and retention<\/li>\n<li>Facility construction, and<\/li>\n<li>Survey and enforcement regulations<\/li>\n<\/ul>\n<p>Proposed changes include reduction in administrative requirements regarding:<\/p>\n<ul>\n<li>Resident rights<\/li>\n<li>Admission, transfer and discharge notices to State LTC Ombudsman<\/li>\n<li>Timeframes for retaining facility-stored date (i.e. nurse staffing data, evidence demonstrating results from resident grievances, etc.)<\/li>\n<li>Credentialing for the director of food and nutrition services<\/li>\n<li>Compliance and ethics programs<\/li>\n<\/ul>\n<p>CMS also proposes to:<\/p>\n<ul>\n<li>Remove the requirement for PRN prescriptions of psychotropic medications to be renewed beyond the 14-day limit by an attending physician if the rationale and duration is initially indicated in the PRN order<\/li>\n<li>Streamline aspects of the facility assessment and Quality Assurance Improvement Program (QAPI) requirements<\/li>\n<li>Accept waivers from existing facilities that previously met FSES requirements for compliance with the Life Safety Code<\/li>\n<li>Apply requirements for number of residents per rooms and bathrooms only to newly constructed and certified LTC facilities<\/li>\n<li>Eliminate the requirement to submit a written waiver of hearing rights for facilities facing civil money penalties\n<ul>\n<li>All facilities that do not file a waiver would automatically receive the 35% reduction in penalty amount.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>Additionally, CMS finalizes a <a href=\"https:\/\/www.federalregister.gov\/documents\/2019\/07\/18\/2019-14945\/medicare-and-medicaid-programs-revision-of-requirements-for-long-term-care-facilities-arbitration\">rule<\/a> that updates the requirements that nursing homes must meet to use binding arbitration agreements.\u00a0 In 2017, after directing state officials not to enforce its 2016 final rule on long-term care arbitration agreements, CMS issued a new proposed rule which would have allowed for such agreements between long-term care facilities and residents, effectively prohibiting litigation against the facility. Today, CMS finalizes that rule, but without allowing facilities to make such an agreement mandatory as a condition of admission. In addition, residents must be clearly apprised of their right not to sign such an agreement and have 30 days to revoke their acceptance of one.
